Texas Heirships – How does Inheritance get divided?

Heirships – Wills – Probate …. Oh My!!

I know it can be overwhelming. As a Texas Realtor, I have so much compassion for those who are sorting through after losing a loved one. I have had the honor of helping a couple dozen families through some really hard, confusing things. Here’s my best advice:

  1. If you have time, get a Will prepared by an Estate Attorney. This does not have to be extensive or expensive. But, it is so important to write down what you want to happen! Additionally, it is important to specify an Executor in that will to carry out the probate process when the time has come.
  2. You need to know that if you do not have a Will and specify what should happen to your property, Texas will decide for you.

All questions you have about this should be talked over with an Estate Attorney. If you need references, I would be happy to give you a few to call.

P.S. I do have a chart that was prepared by Community Title Company and is current as of 2022. If you would like to compare your scenario with me to this chart, I can do that, too. Just for a general idea!
